Wrongful Death

If you have lost a loved one due to the fault or negligence of another, and it can be proven that the death was caused in whole or part by their actions, a wrongful death lawsuit is appropriate.

For a wrongful death claim to be valid, the following conditions must be met: (1) the death was caused, in whole or part, by the conduct of the defendant; (2) the defendant was negligent or strictly liable for the victim's death; (3) there is a surviving spouse, children, beneficiaries or dependents; and (4) monetary damages have resulted from the victim's death.

Who can bring a wrongful death suit?

In Colorado, the surviving spouse can bring a claim after the death. If there is no spouse, then the children may bring a claim; if there is no spouse and no children, then the parents of the deceased may bring a claim. In wrongful death cases in Colorado, there is a two year statute of limitation which means that a claim must be brought within two years of the death.
